The Right to Information Act 2005 provides for setting out the practical regime of Right to Information for citizens to secure access to information under the control of public authorities , in order to promote transparency and accountability in the working of every public authority. The Act extends to the whole of India except the state of Jammu and Kashmir .[S.(12)]

  • 1. The Particulars of the organization, functions and duties:

  • 2. The powers and duties of its officers and employees:
    HMT Bearings is a commercial Organisation set up under the company Act 1956, and as such the Powers are vested with the Board of Directors and is further delegated to the director / officials of the company. The powers of Company officials are thus well defined at all levels in the oraganisation. The duties to the officers and workmen  are assigned by the management from time to time.
  • 3. The procedure followed in the decision making process, including channels of supervision and accountability:

    Decision making process is well defined as  per the delegation of powers and the guidelines / manual issued by the Govt. of India and the holding company.
  • 4. The norms set by it for the discharge of its functions:

    a)Maintain absolute integrity and devotion to duty.
    b)Confirm to and abide by the provisions of the rules and regulations of the company.
    c)Zeal to excel and zest for change.
    d)Respect for dignity and potential of individuals.
    e)Strict adherence to commitments.

  • 5.  The rules, regulations, instructions, manuals and records, held by it or under its control or used by its       employees for discharging its functions:
          HMT has formulated the rules and regulation  for the efficient conduct of the operations and  business of the       Company. Some guiding documents are listed below:
  • Articles of Association and Memorandum of Association of the Company.
  • Personnel Manual
  • Conduct, Discipline and Appeal Rules and certified Standing Order of the Company.

  • Delegation of Powers
  • 6.  A statement of the categories of documents that are held by it or under its control:

    The Company holds the Commercial and Technical Documents regarding the Business Operations of the Company and also data relating to its Employees.
  • 7. The particulars of any arrangement that exists for consultation with, or representation by the members of the     public in relation to the formulation of its policy or implementation thereof:

    HMT Bearings Limited has interface with the public through various Parliamentary Committees. In addition, facility has been provided at HMT Bearings Limited’s  website  www.hmtbearings.co.in &  Holding Company’s website www.hmtindia.com for receiving addressing queries / grievances from the general public.
  • 8. A statement of the boards, councils, committees and other bodies consisting of two or more persons     constituted as its part or for the purpose of its advise, and as to whether meetings of those boards, councils,     committees and other bodies are open to the public, or the minutes of such meetings are accessible for public.

    The committees etc are constituted time to time to assist / advise the management as a part of the company’s decision making process. The  minutes of the committee’s meetings can be obtained by the public under RTI Act-2005.

    Agenda / minutes of the meetings of the Board of Directors of the company  are subject to scrutiny by the Internal Audit, Statutory Audit, CAG Office.

  • 10. The monthly remuneration received by each its officers and employees, including the system of compensation       as provided in its regulations.

    The system of compensation to the officers and employees are regulated as per DPE / Govt. of India guidelines – Pay Scale 1992 and the same is adopted by the  company. The current Pay Scales are listed below.

  Procedure for Request of Information
  A. Application Procedure for requesting information
 
  1. Apply in writing or through electronic means in English or Hindi or in the official Language of the area, to the PIO, specifying the particulars of the information sought for.
  2. Reason for seeking information are not required to be given.
  3. Pay fees as may be prescribed (if not belonging to the below poverty line category).
  B. Time Limit to get the information
 
  1. 30 days from the date of application.
  2. 48 hours for information concerning the life and liberty of a person.
  3. 5 days shall be added to the above response time, in case the application for information is given to Assistant Public Information Officer.
  4. If the interests of a third party are involved then time limit will be 40 days (maximum period + time given to the party to make representation).
  5. Failure to provide information within the specified period is a deemed refusal.
 

C. Fees Applicable

 
  1. Application fees to be prescribed which must be reasonable.
  2. If further fees are required, then the same must be intimated in writing with calculation details of how the figure was arrived at.
  3. Applicant can seek review of the decision on fees charged by the PIO by applying to the appropriate Appellate Authority.
  4. No fees will be charged from people living below poverty line.
  5. Applicant must be provided information free of cost if the PIO fails to comply with the prescribed time limit.

  1. If it is covered by exemption from disclosure. (S.8)
  2. If it infringes copyright of any person other than the state. (S.9)
   
 

Fees to be charged from the Public Under RTI Act

 
  1. A request for obtaining information under Sub-Section (1) of section 6 shall be accompanied by an application fee of Rupees ten by way of cash against proper receipt or by Demand Draft or Bankers cheque payable to the Accounts Officer of the Company.
  2. For providing the information under Sub-Section (1) of section 7, the fee shall be charged by way of cash against proper receipt or by Demand Draft or Banker's cheque payable to the Accounts Officer of the Company at the following rates:
    • Rupees two for each page (in A-4 or A-3 size paper) created or copies;
    • Actual charge or cost price of a copy in large size paper;
    • Actual cost or price for samples or models; and
    • For inspection of records, no fee for the first hour; and a fee of rupees five for each fifteen minutes (or fraction thereof) thereafter.
  3. For providing the information under Sub-Section (5) of Section 7, the fee shall be charged by way of cash against proper receipt or by Demand Draft or bankers cheque payable to the Accounts Officer of the Company at the following rates:-
 

For information provided in diskette or floppy rupees fifty per diskette or floppy; and

For information provided in printed form at the price fixed for such publication or rupees two per page of photocopy for extracts from the publication.
